And, I don't think you can 'will' yourself away either. Time to take care of your health -- physical and mental... I know that whenever my H throws out that he's only got ten years left to live... and he's not even 49 yet... and has no health problems... that it pisses me off no end... makes me wonder what kind of an attraction he thinks he is offering me. I gave her the house and i am keeping my retirement plan which is making a lot more money than the house is appreciating... (2) Has an attorney reviewed your plan and documents in which you will "sign over" the house to her? I repeat - you are doing somethiing highly irregular if you are signing over the house to her now, without legal advice, and not in the context of a final divorce agreement. Yes this is the final divorce agrrement that we did together... and no attorney reviewed it When i wote it up I used a copy of a friends that just went through the same stuff....All we need to do is submit it to the clerk of the court and they will ok it....she would get twice as much out of my retirement than I would get if we sold the house. I have talked with realtors about the value of houses within our neighborhood.. I am coming out ahead by about 20 grand in my 401k.... We used a form that we printed online from the state for people who do it themselves. I have it written where she has no claim to my retirement plan and i am giving her the house but she has to get her own financing if she doesnt get it in 90 days the house will be put on the market and sold and my name taken off the mortgage.. I am happy with what I am keeping from this.. The house I dont want and now i can save almost 500$ a month by not paying half the mortgage... So I am happy and she is happy thats all matters.... Have you considered the tax ramifications, i.e. a house is post-tax money vs. a 401k is pre-tax money? All else being equal, if a house is worth $X and a 401k is also worth $X then the person who gets the house gets a much better deal. This could get even more complex depending on if you owe capital gains tax on the sale of the house. There are lots of other things to consider in a final divorce agreement. For example: Is alimony reserved or waived by your ex? If you do not say anything the it is reserved - and you could be in for the biggest shock of your life next year when she comes back and sues you for alimony even though you thought it was all settled. That's all just for starters.. lord knows there is tons more that could go wrong. Copying someone's divorce agreement is like taking prescription medicine from your neighbor's medicine cabinet because you happened to have similar symptoms. now i can save almost 500$ a month by not paying half the mortgage... Huh? If she is living in the house, there is no reason for you to be paying the mortgage now. If you had an attorney he would have told you that. Link to post Share on other sites

I had stated in there that neither spouse was asking for alimony...i made sure and had that written in there to cover my butt... as for the sale of the house I hope she can keep and doesn't have to sell it I would rather have my girls in the house that they grew up in... as for if it sells they will be no captital gains taxes... the first 250,000$ (single) double that if married.. is tax free if you have lived in there for over 2 years which we have.. we covered everything from visitation how many weeks i get her during summer to alternating hoidays.. I have been through this before and Have my first divorce decree which I also used as an example... and about the mortgage when I spoke with 2 attorneys they said as long as my name is on the mortgage and title it would be in my best interest to keep paying half the mortgage which i have done... As far as child support I will be giving her 400$ a month which was stated in there too.. 240$ of that will be used for karate and the rest to support her... I had most of it covered N9... i will carry her on my insurance pay half of college and other stuff i cant think of... Link to post Share on other sites

I haven't spoken with the P.O.S. in over a week which has been nice. Been spending a lot of time with my daughters and granddaughter.. Been on a few dates with a couple women.. One i really enjoy her company she is a college professor and our times together have been a blast. Its nice to have many different topics to discuss during dinner and over a beer. Plus she has a great sense of humor.. as for the other dates well lets just say the didnt look anything like the pictures on their profile ... I took Gunny's advice and starting reading some books of his must read list.. I will say that I still have moments of sadness and the feeling of loss but i guess thats to be expected I still have a ways to go before those thoughts leave my head but they are getting few and farther between...I have scheduled a trip in July to go to Utah and do some mountain biking in the canyon lands which should be a blast.. Work has gotten real slow they laid off more people this friday and hopefully my job is safe for the time being... You all have told me that there is light at the end of the tunnel well I am starting to see that light a little brighter now.... Thanks again to everyone I have met on here... Author skinman Posted June 11, 2009 Author Share Posted June 11, 2009 Hello everyone, Wanted to give an update on my life over the past month... things have been going great for me... I have more woman wanting to go out with me than I have had since high school.... I love it.. only problem is finding time to get together with them all... I guess in a sense that a good problem to have... As for the P.O.S. her life continues to spiral downward.. She has become so bitter over everything, its pretty impossible to talk with her. Its been over 3 weeks since we last spoke....... Man has that been nice. Work has slowed to a crawl.. They took away our paid holidays and made each of us take 5 days unpaid.. Needless to say, money has been tight but its not stopping me from living life.. Gunny,PWS and LakesideDream.. hope you guys are living as good as possible... Thats what I am trying to do..... I'm heading down to Florida for 4 days this weekend, to spend time with a lady I have been corresponding with.. Its going to be nice laying on the beach and drinking a cold one.....will keep you all posted....... Like Gunny has said many times... I have been doing great for the most part, been dating quite a bit between the days that I have my daughter. 2 weeks ago I met such a wonderfull woman, she is filled with so many qualities that my stbxw lacked. Its almost the complete opposite of what I was used to during my marriage. I am taking things real slow, no sex, kissing or any affection yet just spending quality time getting to know each other. Its so nice having someone look forward to hearing from me, or spending time with me with no expectations from either of us. Other than that life is good.. Joined a bowling league, been doing some volunteering at the retirement home in town and trying to get my face seen by as many people as possible... Thanks again to everyone who has stayed with me during these past 9 months.. who would have thought then I would be where I am at now, but you all did. You told me it would get better and it has...
