The problem with cheating is that if your husband finds out he can divorce you and will stand a much better chance of getting custody of the kids as well as leaving you little or no alimony.

Not sure about the legality issue when infidelity is brought up in court. It's diffrent in each state. It's actually hard to prove infidelity in court unless you have pictures or video. Not sure how that will effect the decision in court in terms of alimony or custody cases.

If the husband or wife chooses to commit adultery the other normally will not have to pay alimony (provided that alimony or palimony is required). Because they chose to end the union. And of course he will have to have proof, but here in CA it seems that aligations are enough. :mad:

I am sorry Callisto. Maybe you can speak to another lawyer that may know a loophole or try to get you a better deal in terms of custody and alimony.

 

Apologies, I know it's vague but I can't think of anything else..... :(

I am not in the middle of a custody deal or anything. I am just upset that aligations are enough because it just seems unfair to people who ARE in that situation. :o
