Divorce papers..how long does it take?

Hi,

 

I'm the one who is dating the legally separated man who is now getting a divorce. I thank you for all of your feedback. Since learning from all of you that he may have a new surge of emotions once he signs the divorce papers I am trying to figure one more thing out.

 

Since they already have custody, visitations, property and support lined out in the legal separation agreement all they have to do is now refile the agreement as a divorce and then they are done. In order to prepare myself for an emotional upheaval that he may go through when this happens I was wondering. Does anyone know how long the process of refiling the papers from separation to divorce takes? I would assume after you pay and file it's 30 days but I really have no idea. I don't feel comfortable asking him but I want to brace myself for what may be to come and if I have an idea of the turn around time on this it would help me.

I think the processing time and procedure varies from state to state. You might want to call a divorce lawyer in your state and ask. In some states, it's not even necessary to go to court; the papers are simply mailed to you.

 

Also, I think I missed your original post/thread, but it's not necessarily true that your bf will go through an upheaval when the divorce is final. In many states, all the legal wrangling is done prior to the separation agreement -- which spells out the reasons for the dissolution of marriage, custody, division of property, visitation, alimony, child support, etc. -- and the actual divorce papers are just a proforma. Legally, being separated is closer to being single (for instance, the IRS will allow you file as single if you have a legal separation agreement on file) than to being married. There's no way to know for sure how anyone will react, but if your bf hasn't given any indication that he's still upset or pining for his ex, then there is a chance that there is no further emotional upheaval to be had.

If all the parties agree on everything, it takes only a very minimal time to grant a divorce in most states. Call your local Clerk of the Circuit Court at your county courthouse for detailed information on the timing. Things also vary according to the time of year. There are some times when judges are more busy and things slow down.
