what will the judge say?

Ok- a few weeks ago my stbx agreed to sign a motion for me to file asking the judge to waive the mandatory 6 months waiting period (when you have minor children)....because we needed the divorce papers to help him finance a house (get a loan)....anyway- he ended up not getting the house and now now he has changed his mind and wants to wait the long, tortureous six months. Ugh! I want it over with immediately! We have a court date on June 3. At this point the judge will either grant the divorce immediately, make us wait the six months...or somewhere in between.

The court clerk told me that if we were in agreement, the judge most likely would grant it immediately, sinse we already went thru the complete 6 month waiting period when we were seperated in 2008. We are filing uncontested and on our own. I am wondering if anyone knows: will the judge make us wait the 6 months if we are not in agreement on the motion anymore? Or will the judge compromise and order a few months instead?

Questions: did you already file the motion to waive the waiting period? What is the purpose of the court date on June 3?

The June 3 date was set by the court because after they recieved my motion request, they needed it to be 60 days (at least) from the filing date (Ap 1 was that date) in case it was granted then and there. There is a minimum of 60 days in my state.

So this is a hearing granted to rule on the motion to waive the waiting period that you submitted, which you think that now your STBX - who joined the motion initially - is now going to contest?

yes. That is what I mean. But, I am in the process of convincing him it is the best thing to do, I think he is coming around. I am betting though, if he didn't agree to it, the judge would throw out the motion and tell us we have to wait the 6 months.
