worlybear
In the throes of divorce and have reached decree nisi stage.(Am in the U.K.) Judge has said that ex has to pay all costs. I know it sounds stupid but exactly what are these costs ? Have asked solicitor but didn't get a straight answer, just loads of gobbledy-gook. What exactly does ex have to pay? Anyone out there help? imagine
Costs in South Africa is usually legal costs. The lawyer needs to explain this to you slowly. Your husband is paying.
LittleTiger
Sorry I don't know Worlybear. We did a DIY divorce. We paid court costs up front when I filed, which presumably you've already paid and then £40 for the decree absolute. We agreed everything ourselves so there wasn't anything extra. I'd get your solicitor to clarify. Don't let him gobbledy-gook you. Make sure you get a straight answer. Although if your ex is the one who's paying I don't think I'd be too worried how much. GorillaTheater
I don't do divorce law (thank God), but typically "costs" consist of filing fees and expenses relating to discovery (court reporter fees for depositions, etc.) and may or may not (usually not) include attorney's fees. Depends on jurisdiction. But there alot of expenses relating to a divorce (custody and psychological examinations, guardian ad litem fees, etc.) that I'm not sure are considered "costs" or not, though I imagine they would be. Honestly, your attorney should be able to spell this out.
TaraMaiden
hello Worly. Welcome back, we've missed you. I'm in the UK, and my partner is a recently graduated-with-honours law student. So hopefully, I can help. basically, the administrative costs the court wnts paid, to process all the legal paperwork. It's mainly clerical and secretarial, plus the charge of the Judge to oversee the legality of the paperwork, and make the Divorce go from Nisi to Absolute (Nisi is apparently pronounced 'nee-see', and not 'neye-seye' as many mistakenly believe....) If solicitors have also been involved, these costs are also due. Remember that Solicitors generally charge by the hour, so if either you or your ex- used the services of solicitors, and sat in their office elaborating and having a good moan - this racked up the total. Hope this helped.
Author worlybear
Many thanks for your responses. I've got clearer information from here than in any of my correspondence with the solicitor!
