davidvincent Posted February 22, 2012 Share Posted February 22, 2012 In 2008 we got divorced and the divorce said that the wife agrees to give me the house and that I agree that I would remove her name off the mortage, and then she would then sign a quit claim. She went and got another house and I did not assume the mortage and she was impatient and could only get another mortgage if she signed a quit caim on this one before I got her off the mortgage. I tried to assume the mortgage alone but they turned me down. They said until my circumstances change not to reapply; That was about 3 years ago. Now I am reapplying with my brother but he has bad credit. She then files a motion in a court that I have to attend asking the judge to put a time limit on me refinancing or order that I sell the house if I do not get her name removed. There was no time limit set in the decree but I assume 3 years is seen as unreasonable time and I should have done it by now but I tried and could not qualify and am trying again and what if I fail again?
