StartingAgain Posted June 14, 2004 Share Posted June 14, 2004 Why are you meeting with HER lawyer? Are you nuts!?! Man you are setting yourself up. You get your own lawyer and let the lawyers handle the settlement unless you and your wife are calm enough and on good enough terms to do actually come up with an equitable settlement. DO NOT forget that her lawyer many be smooth and friendly, but s/he REPRESENTS YOUR WIFE, NOT YOU. There are two things that her lawyer knows and IS going to use to his/her advantage: 1) you don't want to piss your wife off. Most men have divorces forced on them and they try to be accomodating. 2) You are an emotional wreck just now and probably not thinking as clearly and as objectively as you should be. Make no mistake about it; your wife's lawyer knows this and is going to play you like a cheap fiddle if you let it happen. My ex's laywer tried this crap on me. I was presented with papers and told to sign them ASAP. One of the papers was that I wanted to waive my right to legal counsel before the divorce was filed in superior court! The other was a Consent to Try. I was insructed to sign the documents within 48 hours. Instead, I took them to my lawyer, who said no, no, and HELL no! Had I signed those papers, my ex's lawyer could have filed them immediately along with a property settlement I had never even seen, much less approved, and I'd be *bound* by it. My lawyer made a counter offer along with direct threat: accept immediately or we are filing a counter-complaint and refudiation of all charges made by my wife. She's still get her divorce, but it would end with her liquidating assets to pay my lawyer's fees (which he would run sky high). My wife's lawyer immmediately backed down and accepted the offer for settlement. So for a few hundred bucks, I saved myself nearly $100,000. Link to post Share on other sites
