Campn
I got married in 2010 and expecting our first child late summer of 2012, my husband and I fight every single day, I can no longer live with him, he's abusive mentally and emotionally and I can't love him anymore. I came to the US from Egypt, I've no job and no drivers' license, we own a house together (my dad gave us the down payment on it) I'd leave him in a heart beat but I've no one to support me at this moment, not owning a car makes it hard to go anywhere without him. Could he take my baby from me? what can I do without a job or a car?
xenomorph
that's heartbreaking ((hugs)) Before anything else: Would your husband be willing to go to marriage counseling ? Do you have access to individual counseling ?
Steen719
Are you naturalized? Your status might be an issue. I think there is a waiting period before you can be naturalized and thus be able to remain here without problems. If you have a friend, ask them to help you find an attorney. You need to ask your father for the money to go to an attorney and get some legal advice. My concern would be if you are not a U.S. citizen, this could pose problems for you leaving. Sorry for your situation. Hope it gets better.
Texsec
How long have you been Married? Was it on a K visa? what is your green card status? Usually if you have been married 2 years or less you have a conditional green card that is valid for 2 years. You then have to show you are still married and get the restrictions lifted and a 10 year card issued. After you have been in country and married 3 years, you can apply for citizenship....DO NOT leave the country till you research this if you want to remain here. As far as taking your child away what grounds would he have? He brought you here, married you, supported you, got you prego, he will be responsible for child support, maybe alimony depending on your state....Get some legal advice.
