Stone Posted June 28, 2004 Share Posted June 28, 2004 I've been on the phone with lawyers office's all day I just have one question and they wan't a "consultation" with a huge fee. and I don't even know if this is legal. So I figured a "SHACKER" might have gone through this once CAn you legally change the last name of a minor without the biological parent being present? I would appreicate some advise. I would like to change my son's last name to mine since his father has been MIA for the last 3 years and is never coming back. I have full custody. I don't see why I would need him to do this. CaterpillarGirl Posted June 28, 2004 Share Posted June 28, 2004 Well, this is what I found: "When the change of a name is for a minor, the application for a name change must be brought by one or both of the minor's parents, but if the minor has two living parents and one does not join in the application, that non-petitioner parent must be served with reasonable notice of the application and, if that parent objects, a hearing will be held to determine whether the change of name is in the best interest of the minor. If you anticipate that the non-petitioner parent will object and/or if the non-petitioner parent does object our product should not be used and a registered attorney in your area should be consulted."
