I love the boy as any father. My wife filled the divorce and stated the baby is not mine. Now she wants half of the property. We live in Illinois, can she do that?

Honestly, we seek out attournies for stupid crap like coffee being too hot but in this country if somebody takes your kids, your home, you dignity and all you have worked for all your life it's 50/50 split of assets or worse even though they were the ones that cheated and caused unimaginable suffering. If that doesn't work sell everything and split the money. Adultry only applies with alimony. If she has a job alimony will be none or less. Just throwing you the basics bro. Consult with a lawyer. Chi townD Posted July 30, 2012 Posted July 30, 2012 Illinois is one of the last AT FAULT states in the US and adultry can be issued on the divorce decree. It will be factored into the divorce and would be benefical to the OP.

If adultery is proven, or if fraud is proven, the assets are divided differently. My D is now in the middle of a divorce based on long term adultery, with much marital money spent on 2 different OW. She was awarded child support and alimony plus her lawyer fees paid with more to come in the final stages of the divorce.
