mikeod
DNA test showed I am not the father of a 3 months baby after 10 years marriage. I am white, she is Asian, the baby does not have any figure from me. I love the boy as any father. My wife filled the divorce and stated the baby is not mine. Now she wants half of the property. We live in Illinois, can she do that?

Darth Vader
What a slag..........sorry mate, that's the worst. Fight her all the way! Contact a lawyer, a very good one! Ask about paternity fraud with the lawyer and make sure you have the paternity test as proof!

g450
Adultery should be a factor in divorce rulings. Yes it should be. In some countries you can get killed for it. Maybe they have it right. Honestly, we seek out attournies for stupid crap like coffee being too hot but in this country if somebody takes your kids, your home, you dignity and all you have worked for all your life it's 50/50 split of assets or worse even though they were the ones that cheated and caused unimaginable suffering. Go figure!
TaraMaiden
Adultery should be a factor in divorce rulings. Adultery IS a factor in divorce rulings - but it doesn't over-ride statute.
g450
Adultery IS a factor in divorce rulings - but it doesn't over-ride statute. It depends on the State. All state laws are different.
Soxfaninfl
Every state is a no fault state. She could be banging the local police department and a judge won't care. Anyone can request to get divorced. Everyone now gets divorced for irreconcilable differences.
jgregory4614
The property you bought while y'all were together will get split in half. Half is your and half is hers. Maybe try to nagotiate. If that doesn't work sell everything and split the money. Adultry only applies with alimony. If she has a job alimony will be none or less. Just throwing you the basics bro. Consult with a lawyer. Research the law in your stae. Get as much info as possible then see what options you have. Good luck with everything. Love Life!
Chi townD
Illinois is one of the last AT FAULT states in the US and adultry can be issued on the divorce decree. It will be factored into the divorce and would be benefical to the OP.
Author mikeod
Thank to you all, but sad and sad! Thank Mom and dad and all my friends being so supporting.
beenburned
soxfan, There are 13 states in the US that are still fault states. If adultery is proven, or if fraud is proven, the assets are divided differently. My D is now in the middle of a divorce based on long term adultery, with much marital money spent on 2 different OW. She was awarded child support and alimony plus her lawyer fees paid with more to come in the final stages of the divorce.
