In TX, when is it LEGAL to start dating someone else so's not to mess up any chances at getting a judgment in your favor?? I know hearings don't start till 90 days after initially filing for divorce. And you can remarry after only 31 days of the divorce being final. If one party wants a divorce and the other doesn't, do you have to wait till the divorce is final before you can start dating?? I am in a situation where I want a divorce but my wife doesn't. I have found someone I do want to be with very much but I've put that on hold as I don't want to make it any harder to get custody of my kids. I am almost 100% sure I can get custody just by prooving her an unfit mother. But I don't want to take any chances of losing them. PLZ help if you can. Thank you. Link to post Share on other sites

He had already filed, had moved out, etc, but when his wife found out he was already dating she completely flipped out and actually tried (and failed) to prove that he had met me before he filed for divorce and was the "reason" he was divorcing her.
