NYC-BigKat
This is so so bad u know . He says since I cant make it in he will fire me & mail me my last check so I tell him please give me a extra hour & I'll come in & then he says no just stay home if its that bad but in the future I gotta take a cab or whatever no matter how bad the weather is. He sounded so mean! I texted him if I can make it up by going in tomorrow to do some work but he not answering me . I just finished working 10 days straight last week & he acting like I missed lots of days. He also only paid for me for 5. Anyone else get a boss this terrible??
IfWishesWereHorses
Contact you labor board. Not paying for time worked is against the law.
KathyM
Nothing like a call or letter from the Department of Labor to help an employer to realize that he can't just do whatever he wants. I've had to contact them when I quit a job in order to get my last paycheck. A friend of mine called the Department of Labor when her boss wouldn't let the employees take a coffee break. If your boss is expecting you to come in when it's dangerous conditions to do so, maybe a call to the Department of Labor will help him to realize he can't just treat employees that way and get away with it. If he fires you over this and the conditions really were hazardous for you to try to come in, then you may also have grounds for a wrongful termination lawsuit.

Thank u kathy for giving me a really nice reply . I called my coworker & talk to him about it & he says the dept of labor cant do nothing 'cause this is a private company & lawsuits only apply to regular businesses & how he has worked as much as 3 weeks straight in the past & only paid for 1 week but says its normal for private places. Please tell me my coworker is wrong 'cause I really want u to be right.
Art_Critic
If you need the job then don't go filing a lawsuit over this, being made to come in via a cab might not be considered lawsuit worthy.. it all depends on the perspective, if you were trying to use the weather to get out of work then filing a complaint would just bring on issues at work.. The working without pay however would be considered something you should get straightened out, if there is documentation that you worked, meaning a time slip or something then you need to either straighten it out with him or decide if this job is for you, because filing a complaint is putting a target on your back to be the next let go because of the economy. I would start looking for a better job now and if you can secure one then go ahead and file a complaint on the working without pay issue. Being a private company doesn't mean that they can do what they want, the labor laws still apply to them. If however you are working under the table and he is paying you in cash then there is nothing you can do.

They were very helpful in my case, and in my friend's case, her employer treats her like a queen now after she got the Department of Labor involved. I would think that these same rules apply to companies regardless of whether they are public or private companies. But talk to the Department of Labor, and find out what your rights are. Radu
I don't think he'll fire you. I think he'll use it to keep you on the defensive. Still, inquire with the Department of Labour, but do not actually pull the trigger on this unless you are sure you want to leave.
anne1707
Am I right in thinking you have only had this job for 3 or 4 weeks? Have you taken any other time off or been late since you started the job?
clia
Is your boss refusing to pay you or have you just not reached the end of the pay period? Why do you continue to work there if you aren't getting paid? Are you a salaried or hourly employee? Are you being paid under the table? Finally, I've never had a snow day in any professional job I've had. We had two feet of snow a couple years ago and my office was open. Did everyone else in your office manage to make it in? Keenly
To the part where you said " the labor board can't do anything because it's a private company" are you serious? ALL companies are.private...

I would report this scumbag on the double. He obviously got people scared at this stupid workplace you're at. I once had a boss try something similar on me years ago and I told him I'll be waiting for your ass when you get out. He apologized and begged me to just leave and gave me extra money inside of my last paycheck. Lucky for him, it worked. Lowlife bosses like this guy you're dealing with are everywhere, especially in this crappy economy. They feel like they're god and can take advantage of anyone; and in this case you're a new worker from what I gather. Just let this guy know what's up and follow everyone else's advice. Or you can be like me and work for yourself. I hate bosses and always will.

Have you taken any other time off or been late since you started the job? Nope never late once since starting last month. I been there 5 weeks & had just 5 days off altogether. I worked lots of days u know. Its a really small company with 4 workers onsite & he uses 3 outside contractors when we get super busy but I been working like a dog sometimes doing 12-14 hours in a row for days u know. I really wish I shoulda took that connecticut job since it was public & full of workers so no one gets this treatment but I never heard back from then .

Are you hourly or salary? Sometimes when it snows customers don't stop demanding service, and most of your workforce fails to show up... so it can be very stressful on management. If the guy isn't paying you properly... then you NEED to get that sorted. Believe that your effort is valuable and must be compensated.

Its hourly not salary & before that stupid 10 day work week I worked 8 in a row & was only paid for the usual 5 then 5 again after the 10 days so I know its unfair. I only told him that I dont think I can make it. I didn't say I cant make it at all & then I told him I will come in but to give me a little time like a hour & he said never mind just stay home so I did try & he just countered me away anyway & he didn't even answer my text about doing a shift tomorrow by myself to make up for it . Is it possible that you have not been paid for that week yet? When did you work and how are they supposed to pay you? Seriously... if they are cheating you full days of work that is a super big deal! You cannot put up with that. I don't care how much snow or rain NYC had. Personally I think your boss is being a bit petty, but it's just a personality conflict. Not getting paid should be your first priority.

It is NOT HARD to at least treat people how they deserve to be treated! Unfortunately, a lot of people have bad genes, and fundamantally lack much empathy or emotions. ............Anyone who treats other people like cr@p and does not feel bad about it, is scum. You need your job, but your NOT GETTING PAID for DAYS YOU WORK! PLEASE, please do this: - ring up the people that KathyM said to ring, and find out the best course of action, in regards to your underpaid working situation - be extra good at work, while your secretly looking for another job - Look REALLY Hard for other work!!!!!!!!!!!!

Not getting paid should be your first priority. It is not petty. Her boss is a nasty person. Kind, nice people who care a lot about others do not talk to their emloyers like that; they dont like go " boo hoo, I am gunna fire you because the weather, something beyond your control, is hindering you from coming" I am going to try to get my masters when I come to the end of my degree, in an area that makes me MORE competitive in the work force, and thereore have more options.. It saddens me to know I will need to be more competitive, in order to avert terrible bosses! I know I will have to do it, cos I sure aint going to work for free, or get fired or bullied for not being able to get to work if I am severely ill or if I really CANNOT GET THERE.... .....Seriously, if you cannot get jobs easily in your career, and if you are really forced to stay in jobs where the bosses are this horrible, why not get a masters degree, or get better qualified? People like your boss should not be alive, the world would be a better place without them; I wish people like you had plenty of options to work for others, if the person who hires you is incapable of treating their staff well.

Hey I've had really $hitty ********* bosses in my lifetime. so many that I'm on my own now as a tradesman in the funeral business moving from place to place on call and can turn down an assignment if I please by just saying that I'm tied up right now and guess what? these people say okay, maybe next week or whenever I get another case for you. Its that easy when you dont have a boss breathing down your neck. After my last 2 jobs went off south I said its time for me to go off alone and become independent and I got into the perfect business to do so. maybe you should look into that op?
