Attorney question: Motion to Withdraw?

Recommended Posts

I retained my attorney in January and have never really gotten very good

response time from her with phone calls or e-mails. As a matter of fact, she says she doesn't

check her e-mail regularly at all. Phone calls typically get returned in 2-4 days, if at

all.

Finally last Thursday I got fed up when I ended up having to negotiate some

visitation time with my STBX on my own because I simply could not get hold of my attorney. I

called the firm, she had gone home sick, so I spoke with one of the senior partners.

Then this morning I get to work with a certified letter on my desk containing

this Motion to Withdraw citing "Breakdown of communications" as the reason.

WTF???!!! So she can blow me off and blow me off and if I dare say anything

about it she can just leave me flapping in the breeze like this? Her motion date is this

Wednesday. I have a court date on Monday and we're right in the middle of negotiating

custody.

Coincidentally, my retainer just ran out.

Or not?

So can she do this? I don't have the $$ to go retain another lawyer!

Thanks for any thoughts or advice!

it was my understanding that you can file a grievance with the state bar association. as long as you have documentation of trying to communicate with her, i would think that the senior partners would step in. good luck!!!!
