GarrusVakarian
I am currently splitting up from wife. To cut a long story short, Last September I found out she was having an affair with a 50 year old married man. I did try to sort things out with her, she even came back for a little bit, but her heart wasn't in it?. So I told her to go back to her parents to sort her head out. In November she said didnt think we could get through it and it was over. I was gutted, but since then it felt like she was hedging her bets between me and the OM. We have lived apart since then, she went back to her parents. I am in a far better place then I was back in November and I am looking forwards to the future and know I will meet someone else. At the moment I am negotiating with her to buy her from out of the house. My plan is once the house has all been signed over to me and in my name I am going to file for divorce and I am going to name the OM on the papers. Also going to claim the divorce costs back from her. My question is from other peoples experiences, what has been your wives reaction to filing?, even though they have said its over. Have any of your wives, just rolled over and accepted it?. Fight it?. Come back begging for forgiveness?. I have discussed divorce with her but she doesn't seem to want to know. Either way after two years of marriage, I have dodged a bullet and I am so thankful I don't have kids.
carhill
The court will rule on any motions you put in front of it. If you don't live in an 'at fault' jurisdiction, the OM is irrelevant to the divorce. If in a community property state, the 'costs of divorce' will be either settled or adjudicated according to statute. If filing for divorce, you'll pay the filing fees and service fees, presuming no waivers are available to you due to your economic state. You certainly can seek to collect some or all of that back during the process. From the other side of the aisle, as a fMM whose wife filed, I had a nice chat with the sheriff deputy when he served the papers and we divorced generally without rancor. YMMV.
