How long did your divorce process take to finalize?

Is there any advantage of speeding up the divorce because of an adultery? My husband is having an EA and wants a divorce. From my current POV, why would i speed of the divorce process just so he can get together with her sooner?

There may or may not be.

 

First, trying to prove adultery may be a long & complicated process, possibly involving such Mickey Spillane things like private detectives.

 

A more basic issue is what does the law provide in your state? That is, would proving adultery entitle you to a larger monetary or property share? It may impact child custody.

 

Here in Wisconsin, community property laws are such that adultery would not impact a settlement. In fact, under current law, adultery is not even grounds for divorce. Divorces here are "no-fault," simply a matter of "irreconcilable differences," and marital property is divided evenly.

 

This is very general information, of course. You would be well advised to discuss the particulars with your attorney.

My divorce was filled the beg. of April and our court date is July 5th, I think 3 months is pretty quick. He paid all the divorce fees, b/c he is the one that wants this. We pretty much agree on all of our assets. We have no children and do have a house. We have agreed to sell the house and split the profit. Not that divorce is easy, but it is easier and cleaner for me to just agree to everything and not have a hearing. Having a hearing would last months, and I just can't put myself through that emotionally.

 

I have my own lawyer, which I am paying, but she is a friend of the family so is charging me next to nothing. I hope he is paying top dollar for his lawyer.
