It's taking so long

My divorce that I filed officially on the 7th still no where in the system. What gives? I really don't understand it. It took 1 week to divorce my 2nd husband. It happened so fast I laughed in court because it was crazy to me how fast it went, we were still living together, even sat next to each other in court, judge was like you agree, ok done.

 

I feel like something is wrong, should I refile? I called social security they referred me to the ftc. I file a general complaint.

Depending on your state ...there's a 90 day "cooling off" period

 

Also ...the social security will put a letter on file on your SS number so no one can open credit on your number ...that's not an FTC issue ...I'm not sure what you told them but this isn't adding up.

Different states have different minimum days. Maybe he hasn't responded in which case after so many days you can ask the court to give you a default judgement--meaning you get basically what the law says you get without a fight.

When the case was filed with the clerk of the court it should have been assigned a docket/case number. Also, if process service was required, generally the case, there should be proof of service. I recall our case summary was in the online system by the time I was served and that was three business days after exW filed. The sheriff who signed the service ledger with me submitted that info and the proof of service showed up in the case summary a couple days later.

 

The clerk of the court in the family law division would be my first stop and, if things seem to have gone sideways, I'd check in with the court's self-help desk to determine next steps in process to rectify any issues. I found the court people to be very helpful with process, if the right questions were asked. Your court will have their own processes and culture.

I called the court over a week ago, she said they are dealing with staff shortages and are behind. I stopped by a few days ago, that area was closed, the other court department looked but found nothing in their system. Based on my conversation over the phone and the closed area. All staff was gone, sick, or whatever including her. She said she was the only one working at that time and was still doing September stuff, about 2 weeks behind she said than, and mine was in her to do bin.

 

Social security told me what he did should be reported to the FTC, also I can go down to the office and file out a form. Right now not a priority.
