I've been given contradictory information by the court staff and wanted to see if anybody here knew something about the issue I have. It's really quite simple My decree Nisi was issued by the court/judge on the 9th of December '16. When I first talked to them on the phone they told me that I could count 6 weeks from THAT date to apply for the decree Absolute. Second time I phoned the court they told me I needed to wait six weeks FROM THE MOMENT I RECEIVED THE DECREE NISI NOTIFICATION ON THE POST to apply for Decree Absolute By experience dealing with their super slow post I know I will probably receive the Decree Nisi notification on the post in February '17 thus delaying further the whole thing. Does anyone know which one applies? 6 weeks from issue or from receiving it on the post to apply for Decree Absolute. Thanks in advance! Link to post Share on other sites
Arieswoman Posted December 14, 2016 Share Posted December 14, 2016 jdavid321, Are you using a solicitor for your divorce, because if so, he/she is the one to ask for clarification? I understand that the Petitioner (that is the person who issues the divorce petition) can apply for the decree absolute six weeks and one day after the date of decree nisi. If the Petitioner has not applied for the decree absolute four and a half months after the date of decree nisi then the Respondent (the other spouse) can apply for the decree absolute. I am given to understand that the Courts don't sit over the Christmas period so that could delay matters. You really need to get professional advice on this one - sorry.
