You have to be legally separated and living apart for 2 years before you can apply for a divorce. All the custody and assets are usually dealt with during these two years and often people don't get around to filing the final divorce papers (as it's another cost) until they have to. Michelle ma Belle Posted August 22, 2017 Share Posted August 22, 2017 I varies and depends on a number of factors not the least of which is if a spouse contests or drags things out for one reason or another. I'm in Canada. My divorce was amicable. My ex drew up the papers when it was time to file, we went to the courthouse, submitted the official documents, paid the fees and it was over. We already officially separated everything during our separation so filing for divorce took no time at all. 1 Link to post Share on other sites
