jprice984
Say a mother took a picture of her son wearing a necklace made of penises and sent it to friends saying lol? Second part of question. Say she was trying to give her ex husband oral sex in a parking lot while she was drinking and he said no because his daughter was around. And her response was she knows how she was made. Is that worth using in a custody case?
CautiouslyOptimistic
I'd say performing a sex act in a public place in front of a minor would qualify as something worth bringing up in a custody case. The necklace not so much.
basil67
I doubt either of them could be used. The penis necklace is a non issue. The sex act didn't happen. If he brought these up against the estranged wife, it would only serve to make him look petty. Family court cares about child safety. It's not so much concerned about the minutiae of stupid stuff which can happen. Edited September 15, 2019 by basil67
major_merrick
If you can't prove it, it didn't happen! And if you CAN prove it, it happened even if it didn't really happen. Got it? If you're trying to get custody and make the mother look like a bad parent, you've got to get better stuff than this, as courts are usually biased in favor of the mother. I got custody of my little sister years ago via family court. I had almost zero proof since my mother was good at hiding abuse. But a friendly judge who happened to be sleeping with a friend of mine made sure that things went in my favor.

If this is all you can dig up on this person this is only going to drag this court case on & cause drama. This is not considered child abuse or endangerment and probably will have zero effect on the judges ruling. It seems like she is a person who has a sense of humor who is now being targeted because of a failed relationship with kids involved. As others have said- If you can't prove it- it did not happen! If it becomes his word against hers in court that is a waste of time and a lot of judges will disregard anything without solid evidence. Is this person a good mother? Does she love her kids and do they love her? What could be your motivation for wanting to take her kids away? Please consider what is best for the children. Kids need their moms.
