House and taxes

Recommended Posts

I was fully divorced in December of 2018. I stayed in house for 9 months of 2019 to get it ready to sell. She had already moved out.  I sold the house in sept 2019 and I paid 9 months of taxes.  How does it work with taxes?  I lived in the house for 9 months and paid taxes.  Her name was on the deed.

You usually pay taxes in advance so if you sell you’ll get that money back at settlement.  Ask your ex to get back half of what you won’t be getting back just to keep things fair.

If she won’t agree then involve your lawyer but try asking first.

It's pretty impossible to answer any question such as this without knowing what jurisdiction you live in, or even which country!

Also which tax are you talking about - council tax, capital gains tax, stamp duty...

Assuming you're talking about a monthly tax amount payable for the privilege of living there, most people's common sense / morality would say that if you're the only one living in the house then you're responsible for paying the taxes, and she would be responsible for paying taxes wherever she is living.

If they're taxes based on the sale of the property then split 50/50.

But as I said - we have no idea where you live or which taxes you're talking about. I would speak to a lawyer or citizens advice to get some proper information, rather than asking for tax advice on an international internet forum.

OP, do you have a settlement agreement and if so what does it cover on the house disposition? At the time of dissolution did you own the house outright, no mortgage? Is your name on the house too? You mentioned her name is on the house.

If you incurred no other housing costs, just the taxes and usual utilities, etc, I'd call the deal even, trading fix up and taxes for living there and not having to rent anywhere. Split the proceeds as per the agreement and move on. If you left out stuff, post that up. Whatever you do work out, make sure it's in writing.
