sandyshortzzz
Going through a breakup, with all of the ups and downs. However, gf has been living here for the last few years, through the pandemic. Things are getting worse, and I'm not sure what to do. I've asked her to leave, but she won't. Any advice? This is in VA. No lease, but she's been here a while, and I'd like to do this as amicably as possible... Thanks for your time. SS

Speak with a lawyer in your jurisdiction if you have doubts. Why isn’t she leaving? Do you have kids together? Who owns the home?
Author sandyshortzzz
Thanks for replying. I own the home. It's where I live too. I may have to go that way. I hate this.

I’m very sorry and empathize. Talk with a lawyer even if it’s a consultation and to ensure what you know is correct. It’ll put your mind at ease having a neutral third party legal professional on your side covering all bases. It’s not worth it guessing through this. There may be other items to go over such as shared debts/expenses and other shared property even though you own the home.

You can't just kick her out. You need to give appropriate written notice and if that is ignored, you have to pay attorney and go through the appropriate eviction process. If you don't do this she has every right to sue you for an illegal eviction. You need an attorney or at the very least familiarity with the tenant landlord laws in your jurisdiction.
