I got paper work from him saying my divorce was filed in june 2003...I got remarried oct 2004 to someone else. now that I'm getting divorced again my ex has just told me that our divorce wasn't complete till jan 2005...so now I am worried I am going to get in trouble for getting married while still married to someone else. I'm somewhat suprised that when you filed for a marriage license that you weren't asked to show divorce papers. Link to post Share on other sites
933KJL Posted November 1, 2005 Share Posted November 1, 2005 It is not poligamy---it is bigamy! I am not sure how much anyone pushes that law any more but I would go see an attorney pretty fast. Filinig for divorce and BEING divorced are two different things...in a major way. I have a friend who filed three years ago and it is JUST finalized now. I filed in August of 2000 and was done in November 2000. It ain't over till you have a court signed paper in your hands. When I had my hearing, the judge even warned us to NOT get married until the official document came from the court. I would think that your ex could make an issue out of this---and depending on the demeanor of your new soon to be ex, he can probably as well---he can file for divorce on the grounds that you never told him you were married and then the court's hands may be tied. Oddly enough, when DH and I eloped in Tennessee in 1992, he just checked off boxes saying he'd been married and divorce twice before. No dates asked, no paperwork questioned, nada. However, I'm guessing because it had been 10 years between marriages 2 and 3, it wasn't such a big deal. Unless that's how they did it in TN back then? Link to post Share on other sites
TUDOR Posted November 1, 2005 Share Posted November 1, 2005 Lonestar is right, your second marriage is not legit and you can have it anulled on the basis you weren't legally divorced when you entered into the second marriage which makes it null and void. But you do need to speak to a lawyer because there are still issues of seperating property, and if any kids... that will need to be addressed as well.
