non-marital assets

I posted this on "breaking up" but think I should have posted it here...

 

Ok, about 4 mo. ago I left the bf I was living with, I just got sick of his narcisitic and sometimes violent/posessive behavior after 5yrs of being controled by him.

 

Any way, I took only what I needed so I could get out fast before he caught me, I just did not want it to turn into so many times when I told him I was going to leave and he became crazy.

 

Now I am trying to get the rest of my stuff but I do not have the money to take hime to court for it, I am afraid to go to his is house because I do not want the drama.

 

So my question is, if I am still on the deed to the house is it unethical or illeagle to break in and get my things? The reason I say break in is because he had the locks changed. I only intend to take the rest of my personal belongings and leave the things that we bought together or were given to the both of us.

If the house is in both your names then you are within your rights to hire a locksmith to gain entry to the house. I say locksmith because you need to avoid causing damage to the house by "breaking in" and save yourself some future headache. But the term marital property does not apply here because if it was only a b/f there is no marriage.

 

I would try to work this out with him first before taking any rash action but if you must get your things back then you can not be found guilty of any crime for removing your belongings but I would make sure you have a copy of the house papers showing your name on it when you do this as proof you have right to be there to avoid any problems.

Darn.. I just caught that you are not married..I posted on your other thread

 

I would show up with a deputy while he is there... Get your stuff and move on..

 

 

The house is yours as well as it is his... Tudor is right.. you can have a lcoksmith pick it for you
