1AQUARIAN Posted April 20, 2006 Share Posted April 20, 2006 I'm not sure which way my situation will go as of yet. Contested or uncontested divorce. At first when we separated my H said, "Just give me a paper to sign you can have everything". NOW that we've been separated for two months I just told him I want a divorce.he's totally changed his attitude! I KNOW he is angry right now, and is "looking for us to get back together", and I think he's just doing anything and everything to prevent me from getting the divorce. People have mentioned "Buying out" the spouse for the house. How does that work??? How do I start???? We've been in our house for 10 years, still owe about $60,000....house probably would sell for $180000-$200000 now. So does that mean I would have to give him $70000?????!!!! How would I do that?? I'm HOPING he will settle down and accept that there is no chance of us getting back together, so we can down and work things out ourselves....(uncontested)....I'm hoping we can agree to my staying in the house with our two teens until they both graduate highy school and are 18 (three years).each contributing half to the mortgage.and then sell the house and divide the profit.....DOES THAT SOUND FAIR??? I just don't want to uproot the kids with them being so close to finishing school and becomming adults. Any advice? Thanks:confused: Link to post Share on other sites

The rules vary by state and by situation so it's hard for someone to tell you what's happened to them and it be right. You need someone to represent you in all of this....... Art_Critic Posted April 20, 2006 Share Posted April 20, 2006 Almost all Divorces that kids are part of the mix are Contested divorces by default because the Judge is the one that has to set the child support. Uncontested divorces are for people without kids or for the very unique couple that can agree on how much child support to pay. Seek legal advice from an Attorney..and do not accept advice from your spouse on what you can or cannot have.. that is just stupid.. Link to post Share on other sites
