Breaking the 2yr seperation

Recommended Posts

Is it true that upon waiting for your 2 year seperation to end so there are no grounds for divorce as long as you both agree .BUT if you sleep together you are breaking the 2year seperation so it has to start all over again because you havent formally been seperated cos you have been intimate together???

I think it depends on where you live. Where I live, we have to be separate for a year before we can even file for a divorce. However, we can live together for 3 months during that year to try to reconcile, and if it doesnt work out, we wont have to start the waiting period all over again.

Did you sleep with your exh?

Check with a divorce lawyer in your locality.

In VA, the separation must be continuous for six months (no children) or one year (with children) in order for a divorce to be filed. 'Continuous' means zero cohabitation and zero sleeping with s2bx during the separation period otherwise you are not considered 'separated'..
