I cannot afford an atty & legal aid has no one available to attend court with me. I am the plaintiff & I am very scared to do this. Scared to walk in on my own. Please advise. Thank you. There should be an abuse center in your area who will be able to provide an liason to go with you . Call around and see if there is a center or shelter. Link to post Share on other sites

DAP told me & gave me the # F/legal aid. Legal aid told me the atty is not available to accompany me on thursday & to tell the court to have the hearing continued. I don't want to ask for a continuance. I can't handle any more. What I am trying to find out is, what could happen if I show up w/o legal assistance? I really don't want a continuance. If legal aid does not have anyone , oyu can be assigned a liason through the counciling center of local shelter in your area . Legal aid and the liason are not the same thing . The judge does not have to give you a continuance , and it would be best if you had someone there with you even if not an atty that knows the ins and outs of how the court works. Call around . melodymatters Posted December 19, 2006 Share Posted December 19, 2006 i have been through this before. I was lucky enough that legal aid had somone availible. Do NOT wait and get a continuance !!! Ask the domestic violence shelter if one of their advocates could accompany you, they have people on call 24 hrs a day. Worst case, bring a friend, and just stand up and tell the judge the same things you wrote in your complaint, and I'm sure he will grant it for you. GOOD LUCK !!!!!! Link to post Share on other sites

He read what I wrote & said there was no just cause for him to issue a pfa. He thought there was no imminent danger posed of me or my kids. He would not let me explain how my 12 year old son called 911. He interrupted me & said, I'll sign the order because you have an emergency order from the weekend. I was soooo upset. So if I go in there with no one, he might just deny the PFA. Why? Because my bf didn't stab me there's no need for protection. I beg to differ. Judges suck. Link to post Share on other sites

In my county you have to have three documented cases of abuse, either when you called the cops or when you actually press charges against the guy, before they issue a restraining order. It sucks but I was lucky enough that I had called the cops and dropped charges a few times by the time I got my restraining order against my ex. There should be advocates that will accompany you for moral support, too, if none of your friends can attend. Link to post Share on other sites

Author peacelove Posted December 19, 2006 Author Share Posted December 19, 2006 Well, I have only 1 documented case. On Tues., Dec. 12th when my son called 911 & the police came out. Then my bf called & said he was coming back home because he paid half the rent. That's when I called the PD & they told me to file for an emergency pfa. I did on Sunday. 12/17. That was only good for 24 hours. I was at the court house for 6.5 hours yesterday to file for a temporary pfa. Which is only good thil Thursday, 12/21 when I am due in court for the hearing for a permanant pfa. Doesn't the judge see that I am not doing this for entertainment? Like I really want to do all this headaching for the he// of it. I know it's only 1 documented incidents (out of a million that I didn't report) but my goodness...I need help here. I remember that I had to be a witness in court against my ex because he tried to choke my friend to death in my house. The defense attorney made me cry so many times and kept saying I was lying. It just shocks me that people are like that about abuse. Like women make it up or something. That is the dumbest thing in the world, no one would make up sh*t like that just to get attention. They seem to take it alot more seriously if they know he does, and that it could come back and haunt their political and judicial career is the a**hole shoots you after they denied you a protection order !
