Mother was taken advantage of by Windows company

Ok First Off I will tell you all how my mother is mentally ill. Well about 1 year and a half ago soon after my Father's Death, My Mother meets the Eerie Contruction Company.(WARNING NEVER USE THEM THEY ARE SCAMMERS) She had a cracked window (tiny crack) in her front living room window. She called around to get it fixed. This is how she met these ***holes.

 

They begin by telling her that if she does not get that fixed along with all the other windows in her house, that her house will basically fall down cause its ruining the fondation.(mind you this is a 8 year old house...) She decides to get the first set of windows that end up costing 15 thousand dollars! ya you heard me right 15 grand!$%*^! for 6 windows. Regular house windows. A few months later they come to her house again. They tell her they can give her a awsome deal to get the rest of her windows done. She says No I cannot afford. Ok here's where more comes into the story and completely infuriates me. She had been talking to them a lot before when they were installing the other windows, about my father and his passing on. Well since they know this they make up a completely RIDICULOUS LIE. They say that they know a woman who's husband died and got a Windower's money or something from the goverment of the amount of 45grand.(...)I guess this is like some new radical sudden change of our goverments policy and a /lotto ?(Sarcastic:mad: )

 

Well as you may have guessed she fell for it. She is easily manipulated. So they put brand new windows on a brand new garage. This garage is only about 1 years old. And the windows they put on the garage dont even get me started they are so ugly they put like kitchen windows on a garage dumb ****er's! So all together it has costed : 21 grand for aprox 15 windows in the house and 4 garage windows at a intrest rate of 13%.

 

Anyways.. I guess my question is. Im going to be taking them to court and possibly representing her. I am not a lawyer. Am I allowed to ask this in court? Would you be willing to take a polygraph test on all this ? And if they respond no, Can I say and why is that? Or should I just Hire a profession lawyer and let them handle it all. I get angry very easy when it comes it scum that are called human beings and blow up.

 

Suggestions/ Comments Would be most appreciated.

In your position I would use lawyers who can present more worthy evidence in court, than polygraph tests.

Yes! You must seek professional legal counsel! The window company will have professionals representing them for sure!

The attorneys have a saying that a man who represents himself in court has a fool for a client.

 

While this is not always true, it can be.

 

Don't think about representing your mother in court, you don't know how the court works, you don't know what questions you can and can not ask or what evidence is admissible. Polygraph test results are not admissible in most jurisdictions. There are ways to bring into the court certain inadmissible "evidence" but it's a careful dance that a good attorney would know how to do.

 

I suggest finding consumer advocacy groups in your State and look on the State website for a consumer advocate or an ombudsman, etc. Also check the license of the company that did the work to make sure that they were legally allowed to do the work in the first place. Talk to everyone you can that is qualified to answer your questions (without mentioning the company name) to find out what your options are.

 

Before you get all worked up and hire an attorney you should know that many attorney's children have been put through college by clients suing over a matter of principle.

Very good advice Craig. But I must say, as a paralegal, this sounds like it's more than a case set on principle. As you said, the OP here should consult with someone more knowledgeable about this. It is not a guarantee that there will be compensation, but it's worth a try if anything IMO.

If this is the company, they’ve already had 6 complaints filed against them in the last 36 months.

If I were you, I’d make it SEVEN and as the others recommended, contact an attorney to handle your case. Court costs (if you can prove your elderly mother was taken advantage of) can be included in the lawsuit amount … UNLESS she signed a contract with these people stating otherwise.

 

If there was a signed contract involved, carefully read the clause (all the tiny print!). If your mother didn’t receive a copy of one, call the company and demand they send you a copy of the “signed” original.

 

Of course, you have to remember that some of these larger compainies hire out subcontractors to do their work. But even if the subcontractors are shadey, it's still the responsibilty of the Contractor to make good.

 

Go after the pockets of the BIG GUY. It's their job to deal with their dishonest workers.
